MFP: Dissemination of Forestry Minister Regulation (Permenhut) No. 43/2014 and Director General Regulation (Perdirjen) 5/2014 regarding the Timber Legality Verification System

Description

The Ministry of Forestry revised two new regulations that will be fully implemented on 1 January 2015, which is Forestry Minister Regulation No. 43/Menhut-II/2014 and Director General Regulation No. 5/VI-BPPHH/2014. Both of these regulations are the details regarding the Timber Legality Verification System also known as SVLK, that covers the entire implementation and evaluation guidelines.

It is a national commitment to establish SVLK as a credible system, thus making both regulations crucial to be informed clearly to the public, especially the stakeholders, namely SMEs/ Home Industries and Farm Forestries. This will assist the processing and issuing of legal documents through the Supplier’s Declaration of Conformity (DKP), including assuring the absence of illegal timber circulating from downstream to upstream. The Supplier’s Declaration of Conformity needs to be performed by suppliers and business simply by filling a statement that the timbers and products are derived from legal sources and are processed legally, without having first verified by an auditor. DKP is expected to encourage home industry players/artisans in obtaining timber from forests subject to rights, where currently most are still without SVLK. On the other hand, to maintain the credibility of DKP, the Government or a designated third party may conduct inspections at any time to check the legality of the timbers.

So far, the implementation of SVLK has received positive support from various parties, including to disseminate the latest revised regulations throughout Indonesia. The Ministry of Forestry specifically requested the Multistakeholder Forestry Programme (MFP) to facilitate the dissemination of the latest revised regulations throughout Indonesia, including mentoring and certification especially for the Community Forest Management Unit and Small and Medium Industries. According to the agreement, the regions for the dissemination event that are the responsibility of the MFP are: DKI Jakarta, West Java, Centra Java, East Java, North Sulawesi, Gorontalo, West Sulawesi dan South Sulawesi.

With the Forestry Minister Regulation No. 43/Menhut-II/2014 and Director General Regulation No. 5/VI-BPPHH/2014, it is expected that on 1 January all businesses use legally sourced materials which is expected to have an impact on the people’s forest conservation.

Additional activities according to the contract dated January 2, 2015 is the facilitation of socialization activities related to the issuance and use of the Perdirjen Export Declaration with the topics are: a) the Explanation of Regulation 97/2014; b) the Explanation of PermenLHK 95/2014; c) Simulation Publishing Export Declaration; and d) a description of financing facilitation for certification / inspection, in the province of East Java, West Java and Bali.

Funding

This program is supported by the Multi-Stakeholder Forestry Programme (MFP) based on the Grant Agreement with OPML-Multi-Stakeholder Forestry Programme 3, Grant Number: GPO.6316.02.006 dated 7 November 2014, with amendments for additional activity dated January 2, 2015, with total funding support of IDR 1,022,050,000 (added with contributions from Penabulu Foundation of IDR 26,750,000) with amendments amout of 42,812,000 additional funds for facilitating the dissemination activities related to the issuance and usage Perdirjen Export Declaration, and a program period starting from 5 November 2014 and ending on January 31 2015.
